Legal Definitions
Legal terms should be read in their actual statute, contract or factual context rather than assumed to have one universal definition.
Context rather than universal meanings
A controller determines relevant purposes and means under an applicable privacy framework; a processor handles data on behalf of a controller. A license grants specified permission, while ownership and authority are different concepts. A policy, draft and executed agreement also have different status.
Legal concepts and regulatory considerations
These explanations are educational shorthand. The relevant law or operative document may define a term differently and should be consulted before relying on it.
How this relates to Remizen
No definition in this guide amends Remizen’s existing Terms or Privacy Policy. It makes no universal determination about Remizen’s legal roles.
Practical review considerations
Key points
- Check definitions in the actual relevant document.
- Distinguish authority, access and ownership.
- Review scope before relying on regulatory terminology.
Privacy roles and transfers
Controller and processor are legal-role concepts whose meaning depends on the relevant framework and actual activity. A subprocessor performs applicable processing for a processor; not every commercial supplier is a subprocessor.
Personal information is information covered by the relevant privacy law’s definition. A transfer assessment examines movement or relevant access across jurisdictions and cannot be resolved from storage location alone.
License and intellectual property
A license grants specified permission to use protected material; it need not transfer ownership. Copyright and trademark protect different interests and have different conditions and exceptions. Public availability of material does not by itself authorize every reuse.
Frequently asked questions
